2012 RESIDENT GIFT CARD SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. VOID WHERE PROHIBITED OR RESTRICTED. SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS. The 2012 Resident Gift Card Sweepstakes (this “Sweepstakes”) begins at 12:00:01 AM Central Time on September 4th, 2012 and ends at 11:59:59 PM Central Time on December 4th, 2012 (the “Sweepstakes Period”).
ELIGIBILITY. This Sweepstakes is open to legal residents of the United States (the “Eligibility Area”), and who are 18 years of age or older at the time of entry. Only individuals may enter. This Sweepstakes is VOID outside of the Eligibility Area and where otherwise taxed, prohibited, or restricted. HOW TO ENTER. You may enter the Sweepstakes online by visiting Brookdale Senior Living’s official Facebook Fan Page and following the instructions to submit your story. Online entries must be received by 11:59:59 PM Central Time on December 4th, 2012 to be eligible. Entries that do not conform to these Official Rules or that are received by Sponsor after the end of the Sweepstakes Period will be discarded and deemed void. Proof of entering the Sweepstakes online will not constitute proof of receipt by Sponsor. No changes to any entry information will be permitted once submitted. No mechanically reproduced or photocopied entries are permitted. All entries become the property of Sponsor and will not be acknowledged or returned. LIMIT ONE (1) ENTRY PER PERSON. The odds of winning the prize will be the same by alternate means of entry as by the first means of entry above. In the event of a dispute over the identity of an online entrant, the entry will be deemed submitted by the registered holder of the email account.
By participating in this Sweepstakes, each entrant: (1) agrees to these Official Rules, and the decisions of Sponsor, which shall be final in all respects; (2) acknowledges that Sponsor has not made and is not responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relating to the prize; and (3) warrants that he/she is eligible to participate in this Sweepstakes.
FACEBOOK RULES. By participating in this Sweepstakes, each entrant:
(1) releases and agrees to indemnify and hold Facebook, its subsidiaries and affiliates, and their respective employees and agents harmless from any and all liability, claims or actions of any kind arising out of the entrant’s participation in this Sweepstakes, the entrant taking delivery of the prize or any prize-related activity, and the entrant’s acceptance, possession, use or misuse of the prize;
(2) understands and agrees that this Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook; and,
(3) understands and agrees that the information provided by entrant on Sponsor’s Facebook page is being provided to Sponsor and not to Facebook.
PRIZE; ODDS OF WINNING. One (1) prize will be awarded. One (1) Grand Prize winner will receive the following: one (1) $500 gift card. The Grand Prize winner must possess required photo identification documents. No substitution or cash equivalent will be offered. Sponsor shall not be responsible or liable for the Grand Prize winner’s inability or failure to utilize the prize. Retail value of the Grand Prize is five hundred dollars ($500.00).
The prize may not be combined with any other offer. The winner will be responsible for all applicable federal, state, and local taxes, including but not limited to income tax withholding if the winner is an associate of Sponsor, fees, and any other expenses associated with acceptance of the prize. The prize is not redeemable for cash, and no substitution, assignment or transfer of the prize will be permitted, except that Sponsor reserves the right to substitute the prize with either the cash value of the prize that would have been awarded, or a prize of equal or greater value.
Odds of winning are determined by and depend upon the total number of eligible entries received by Sponsor. A purchase will not improve your chances of winning.
WINNER SELECTION. On or about December 9th, 2012, a potential winner will be selected by random drawing from among all eligible entries received by Sponsor during the Sweepstakes Period. The prize award is subject to verification and will be awarded upon winner validation and verification by Sponsor. The potential winner will be notified by electronic mail on or about December 9th, 2012. If the initially selected winner is ineligible, cannot be contacted after two (2) attempts, or fails to complete and return any required documents to Sponsor within ten (10) days of receipt of the documents, the prize will be forfeited and an alternate winner will be selected by random drawing from among the remaining eligible entries. The potential prize winner will be required to sign and return an Affidavit of Eligibility/Compliance (including his/her Social Security Number if required for tax reporting purposes) and a Liability/Publicity Release, as allowed by law, within ten (10) days of receipt of the documents or his/her prize will be forfeited, and an alternate winner will be selected by random drawing from among the remaining eligible entries.
Except where prohibited by law, acceptance of the prize constitutes the winner’s consent for Sponsor and its designees to use the winner’s name, likeness, and biographical information in connection with this Sweepstakes for advertising, promotional, or other purposes in any media now known or hereafter devised without review, notification, approval, or compensation, unless otherwise prohibited by law.
DISQUALIFICATION. The use of robotic, automatic, macro, programmed or like methods (including, without limitation, the use of any promotion/sweepstakes subscription, notification, entry or like sites or services that offer sweepstakes entry services “on behalf of” entrant) is strictly prohibited. Any false information provided by an entrant concerning his/her identity or mailing address or any non-compliance by an entrant with these Official Rules may result in the immediate disqualification of the entrant from this Sweepstakes. Sponsor further reserves the right to disqualify any entry that it believes, in its sole discretion, does not comply with these Official Rules. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified. If disqualified, Sponsor reserves the right to terminate the entrant’s eligibility to participate in this and future promotions and contests of Sponsor. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event this Sweepstakes is challenged by any legal or regulatory authority, Sponsor reserves the right to terminate the Sweepstakes, or to disqualify entrants residing in the affected geographic areas. In such event, Sponsor shall have no liability to any entrants who are disqualified due to such an action. In the event any portion of this Sweepstakes is compromised by any unauthorized human intervention, actions of entrants, or other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, corrupt or impair the integrity, administration, security, or operation of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to suspend, modify, abbreviate or terminate the Sweepstakes without further obligation. If Sponsor elects to abbreviate the Sweepstakes, the winner will be selected by random drawing from among all eligible entries received prior to the action or compromise giving rise to the suspension or termination of this Sweepstakes.
DISCLAIMER; LIMITATION OF LIABILITY. SPONSOR IS NOT RESPONSIBLE OR LIABLE FOR: (1) ANY TYPOGRAPHICAL OR PRINTING ERRORS IN THE OFFER, ADMINISTRATION OF THIS SWEEPSTAKES, OR IN THE ANNOUNCEMENT OF THE PRIZE; (2) LATE, LOST, ILLEGIBLE, INCOMPLETE, STOLEN, MISDIRECTED, OR POSTAGE-DUE MAIL; (3) INCORRECT OR INACCURATE ENTRY INFORMATION, WHETHER CAUSED BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THIS SWEEPSTAKES OR BY ANY HUMAN ERROR WHICH MAY OCCUR IN THE PROCESSING OF THE ENTRIES IN THIS SWEEPSTAKES; (4) ANY TECHNICAL ERRORS INCLUDING, BUT NOT LIMITED TO, TECHNICAL MALFUNCTION OF ANY TELEPHONE NETWORK OR LINES, COMPUTER ONLINE SYSTEMS, SERVERS, OR PROVIDERS, COMPUTER EQUIPMENT, SOFTWARE, FAILURE OF ANY E-MAIL ON ACCOUNT OF TECHNICAL PROBLEMS OR TRAFFIC CONGESTION ON THE INTERNET OR AT ANY WEBSITE, OR ANY COMBINATION THEREOF; OR (5) ANY OTHER ERRORS IN THE ADMINISTRATION OF THE SWEEPSTAKES. IN NO EVENT WILL SPONSOR, ITS SUBSIDIARIES OR AFFILIATES, OR THEIR RESPECTIVE EMPLOYEES OR AGENTS HAVE ANY LIABILITY TO ANY ENTRANT OR THE WINNER RELATED TO THIS SWEEPSTAKES OR THE PRIZE AWARDED, INCLUDING, WITHOUT LIMITATION, ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, OR PUNITIVE DAMAGES.
RELEASE. By participating in this Sweepstakes, each entrant releases and agrees to indemnify and hold Sponsor, its subsidiaries and affiliates, and their respective employees and agents harmless from any and all liability, claims or actions of any kind arising out of the entrant’s participation in this Sweepstakes, the entrant taking delivery of the prize or any prize-related activity, and the entrant’s acceptance, possession, use or misuse of the prize.
DISPUTES. Except where prohibited, each entrant agrees that: (i) any and all disputes which cannot be resolved between or among the parties and any claims or causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action; and (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred by an entrant, including costs associated with entering this Sweepstakes, and in no event will any entrant be entitled to an award of attorneys’ fees. This Sweepstakes shall be governed by the laws of the State of Tennessee and any action, suit or proceeding shall be brought only in a federal or state court located in Nashville, Tennessee. The parties hereby waive their rights to trial by jury in any action or proceeding instituted in connection with these Official Rules and/or this Sweepstakes. Should there be a conflict between the laws of the State of Tennessee and any other laws, the conflict will be resolved in favor of the laws of the State of Tennessee. Any and all disputes that arise relating to this Sweepstakes must be filed within one (1) year from the date that the Grand Prize winner is announced.
GENERAL INFORMATION. The failure to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any part of these Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remainder of these Official Rules will remain fully in force.
PRIVACY NOTICE. Any personal information provided by entrants will be used by Sponsor to administer this Sweepstakes and may also be used by Sponsor to contact entrants for marketing purposes and for other purposes as stated in Sponsor’s Privacy Policy located at www.brookdaleliving.com/privacy-policy.aspx. If an entrant does not wish to be contacted, the entrant may submit a request to Sponsor in accordance with the Privacy Policy.
